NOTIFYING AUTHORITIES FOR THE IMPLEMENTATION OF NOISE POLLUTION (REGULATION AND CONTROL) RULES, 2000

In exercise of the powers conferred by clause (c ) of rule 2 of the Noise Pollution ( Regulation and Control) Rules, 2000 read with sub-rule (2) of rule 4 thereof the Government of Kerala hereby designate, the District Magistrates, the commissioners of Police/the Superintendents of  Police and the Deputy Superintendents of Police (Sub-Divisional Officers) as the authorities under the said rules for the maintenance of ambient air quality standards in respect of noise pollution within their respective jurisdiction in the State.

Explanatory Note

 

(This does not from part of the notification, but is intended to indicate its general purport)

 

As per sub-rule (1) of rule 4 of the Noise Pollution (Regulation and Control) Rules, 2000 the noise levels in any area/zone shall not exceed the ambient air quality standard in respect of noise as specified in schedule.  Sub rule (2)  of the said rule provides that the authority shall be responsible for enforcement of noise pollution control measures and the due compliance of the ambient air quality standards in respect of noise.  As per rule 2(c) of the said rules authority means any authority or officer authorised by the Central Government or State Government as the case may be.  At present no such authority has been appointed in the State for the said purpose.  Therefore Government consider if necessary to designate the District Magistrates, the Commissioners of Police/the Superintendents of Police and  the Deputy Superintendents of Police (Sub-Divisional Officers) as the authorities under the said rules to maintain and control ambient air quality standards prescribed under the said Rules.
